Data protection statement
We are pleased that you are interested in our online offering. Protecting your personal data is very important to us. We would therefore like to inform you about data protection in our company. It goes without saying that we observe the legal provisions of the EU’s General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), the German Telemedia Act (TMG), and other data protection provisions.
You can trust us with your personal data. It is encrypted using modern security systems and transmitted to us. Our Web sites are protected by technical and organizational measures against damage, destruction, or unauthorized access.
The ARCA Regler GmbH Internet pages can generally be used without providing any personal data. However, if a person wishes to make use of special services of our company via our Web site, it may be necessary to process personal data.

Specification of legal basis
If it is necessary to process personal data and there is no legal basis for such processing, we generally obtain the consent of the data subject.

Information on protective measures and alternative contact channels
As the entity responsible for processing, ARCA Regler GmbH has implemented many technical and organizational measures to ensure that protection of personal data processed via this Web site is as complete as possible. Nevertheless, Internet-based data transmissions can have security gaps and, therefore, absolute protection cannot be guaranteed. For this reason, any data subject is free to transfer personal data to us via alternative channels, for example by phone.

Rights of data subjects
You can receive information about your data stored by us at any time without giving reasons. We will register your request and answer it within one month of receipt.
You have the right:
• In accordance with Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if it was not collected by us, and the existence of automated decision-making, including profiling and, if applicable, meaningful information on the associated details;
• In accordance with Art. 16 GDPR, to immediately demand that any errors or omissions in your personal data stored by us be corrected or rectified;
• In accordance with Art. 17 GDPR, to request the deletion of your personal data stored by us, unless its processing is necessary to exercise the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or to establish, exercise, or defend legal claims;
• In accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if you contest the accuracy of the data, if the processing is unlawful, but you oppose the erasure of the data, and we no longer need the data, but you require the data for the establishment, exercise, or defense of legal claims, or you have objected to the processing in accordance with Art. 21 GDPR;
• In accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request its transmission to another controller;
• In accordance with Art. 7 (3) GDPR, to withdraw your consent to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future and
• In accordance with Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority for your usual place of residence or workplace or for our company. 

Right of withdrawal
You can block, correct, or delete your data collected by us at any time, provided that your personal data is processed on the basis of legitimate interests in accordance with Art. 6 (1) Sentence 1 (f) GDPR and can object to the pseudonymized collection and storage of data for the purpose of optimizing our Web site. This objection is made in accordance with Art. 21 GDPR. You can also withdraw the consent you have granted us to collect and use your data at any time without giving reasons. To do so, please contact the address given in the Imprint. We will be happy to answer any further questions you may have about our information on data protection and the processing of your personal data.
Please note that data protection policies and data protection practices (e.g. at Google) can change constantly. It is therefore advisable and necessary to keep abreast of changes in the legal provisions and practices of companies such as Google.

Data security
We do not currently use the widespread SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser. This procedure is currently being planned. Whether a particular page of our Web site is transmitted in encrypted form is indicated by the key or closed padlock symbol displayed in the lower status bar of your browser.
We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. We continuously update our security measures in line with the latest technological developments. Nevertheless, Internet-based data transmissions can have security gaps and, therefore, absolute protection cannot be guaranteed. For this reason, any data subject is free to transfer personal data to us via alternative channels, for example by phone.

Currency of and changes to this data protection statement
This data protection statement is currently valid and is the version as of May 2018. Further development of our Web site and our offering, as well as legal and official requirements require regular review and, if necessary, changes to our data protection policy. Subject of data protection
The subject of data protection is personal data. According to Art. 4 (1) GDPR, this is any information relating to the personal or material circumstances of an identified or identifiable natural person. This includes, for example, information such as your name, postal address, e-mail address, or telephone number, but may also include usage data such as your IP address.

Scope of data collection and storage
Visiting our Web site
You can use the ARCA Regler Web sites without providing any personal data. However, if you wish to use specific services from our company via our Web site, it may become necessary to process personal data, e.g. if you wish to receive product information. We see this as a matter of mutual fairness: You tell us who you are; we give you all the information you require and promise to handle your data with care and use it only to process your request. Please understand that we do not want to provide services for fake users. When you visit our Web site www.arca-valve.com (and any other domains we use), the browser on your device automatically sends information to our Web site’s server. This information is temporarily stored in a log file. The following information is recorded and stored, without any action on your part, until it is deleted automatically:
• IP address of the requesting computer
• Date and time of access
• Name and URL of the file accessed
• Web site from which the page was accessed (referrer URL),
• Your browser and, if applicable, the operating system of your computer as well as the name of your access provider
• Country from which the file is called up
The abovementioned data will be processed by us for the following purposes:
• Ensuring smooth connectivity for the Web site
• Ensuring our Web site is easy to use
• Evaluating system security and stability as well as
• For other administrative purposes within the framework of the performance of the contract or for fulfilment legal or regulatory requirements on us.
Our company uses Art. 6 (1) (a) GDPR as the legal basis for processing activities for which we obtain consent for a specific processing purpose. If it is necessary to process personal data for the performance of a contract to which the data subject is a party (as is the case with processing activities required for the delivery of goods or the provision of other services, for example), the processing is based on Art. 6 (1) (b) GDPR.  
The same applies to such processing activities required for performing pre-contractual measures: for example, in cases of queries about our products or services. If our company is subject to a legal obligation requiring the processing of personal data (for example, to meet tax obligations), the processing is based on Art. 6 (1) (c) GDPR. In rare cases, it may become necessary to process personal data to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured at our company and his name, age, health insurance data, or other vital information had to be passed on to a doctor, a hospital, or other third parties. The processing would then be based on Art. 6 (1) (d) GDPR. Finally, processing activities could be based on Art. 6 (1) (f) GDPR: Processing activities that are not covered by any of the abovementioned legal bases are based on this legal basis if processing is necessary to safeguard a legitimate interest of our company or of a third party, provided that the interests, fundamental rights, and freedoms of the data subject do not prevail. We are permitted to perform such processing activities because they have been mentioned specifically by the European legislator, which took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, sentence 2, GDPR).

Newsletter
ARCA Regler informs its customers and business partners at regular intervals about the company’s products and services by means of a newsletter. The data subject can receive our company’s newsletter only if (1) the data subject has a valid e-mail address and (2) the data subject has registered to receive the newsletter. For legal reasons, a confirmation e-mail using the double opt-in procedure is sent to the e-mail address that the data subject originally entered for receipt of the newsletter. This confirmation e-mail is used to check whether the owner of the e-mail address, as the data subject, has authorized receipt of the newsletter.
The personal data collected during registration for the newsletter is used exclusively for sending our newsletter.
The personal data collected as part of the newsletter service will not be passed on to third parties. The data subject can cancel his subscription to our newsletter at any time. The consent to the storage of personal data, which the data subject gave us in connection with receiving the newsletter, can be withdrawn at any time. Every newsletter includes a link that enables the data subject to withdraw his consent. It is also possible to unsubscribe from receiving the newsletter at any time directly on the controller’s Web site or by informing the controller in another way.

Contact form
If you have any questions, we give you the option of contacting us using the form provided on our Web site. You must provide a valid e-mail address, your first and last name, and your company so that we know who the request is from and can answer it. Additional information can be provided voluntarily.
The data will be processed for the purpose of contacting us in accordance with Art. 6 (1) sentence 1 (a) GDPR based on your voluntary consent.
The personal data collected by us for the use of the contact form will be automatically deleted once your request has been processed.

Provision of services
To enable us to actually provide our products and services, we may need your personal data. This applies to dispatching information material and to answering individual queries. We collect this information for the purpose of responding to your request. This data is used only for a specific purpose. We promise to handle your data fairly and transparently. We expect the same of you. We do not provide services for fake users, and this is why we consider it legitimate to serve only real people who reveal their real identity to us.
If you commission us to manufacture a product or to provide a service, we collect and store your personal data only to the extent required for the provision of the service or the performance of the contract and for legal reasons. To this end, it may be necessary to pass on your personal data to companies that we use to provide the service or to process the contract. These include transport companies and other service providers. These service providers are obliged by us to comply with the data protection requirements within the framework of the legal conditions.
Once contract processing is complete, your data will be blocked and deleted after expiry of the tax and commercial law requirements, unless you have expressly agreed to the data being used after these periods have elapsed.

Data collection using AW Stats
To evaluate our site statistically, we use the AWStats program (free web analysis software). It is used to evaluate log files created by web servers on the basis of visitors’ queries. The program does not use cookie files for the evaluation. The statistical analysis is performed using the log files, which also contain IP addresses (see Figure 3). As a rule, this data cannot be assigned to specific persons. This data is not combined with other data sources and is deleted following the statistical evaluation.
Unlike other statistics programs, AWStats does not transfer any data to an external server. The program is installed on our hosting package. Because our server is located in Germany, this also avoids transferring data abroad, for example.

Social media
We operate a YouTube® channel with product information. This Web site is operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube stores data to determine which region you come from (IP address) to check what content may be accessed from your country. This is necessary, for example, to block content that may not be shown in your country for copyright reasons.
If you are logged into your YouTube account, you enable YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

Collection and Storage of Usage Data
To optimize our Web site, we collect and store data such as the date and time of your visit and the page from which you accessed our site, provided that you do not object to this data collection and storage. The data is stored for 1 year.
This is done anonymously without personally identifying the user of the site. If necessary, user profiles are created using a pseudonym. Here again, there is no connection between the natural person behind the pseudonym and the usage data collected. We also use cookies to collect and store usage data.
These are small text files that are placed on your computer and are used to store statistical information such as the operating system, your Internet usage program (browser), IP address, the Web site from which the page was accessed (referrer URL), and the time. We collect this data solely for statistical purposes to further optimize our Web site and to make our Internet offerings even more attractive.
The data is collected and stored exclusively in anonymous or pseudonymized form and does not permit any conclusions to be drawn about you as a natural person.

Duration of storage and routine deletion and blocking of personal data
ARCA Regler processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage or as far as this is provided for by the European legislator, or another legislator, in laws or regulations to which the controller is subject.
If the storage purpose is no longer applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with legal requirements.
The criterion for the duration of the storage of personal data is the relevant legal retention period. After this period expires, the corresponding data will be routinely deleted, provided that it is no longer required for the performance of the contract or for precontractual purposes.
Temporary storage of the IP addresses of Web site visitors, for example, can be justified by protection of one’s own legitimate interests if this storage is necessary to ensure the security of the Web site against attacks. Usually IP addresses are stored for these purposes for no longer than 14 days.

Existence of automated decision-making
As a responsible company, we do not use automated decision-making or profiling.

Use of data for specific purposes
We observe the principle of data use for a specific purpose and collect, process, and store your personal data only for the purposes for which you have provided it to us. Your personal data will not be passed on to third parties without your express consent unless this is required to provide the service or for performance of the contract. Transmission to state institutions and authorities entitled to information also takes place only within the scope of the legal duties of disclosure or if we are obliged to provide information by a court decision.
We also take internal data protection very seriously. Our employees and the service companies commissioned by us have been obliged by us to maintain confidentiality and to comply with data protection provisions.
